By accessing and using FirstReaction (“we,” “our,” or “us”), owned by Ratnamala Jartarghar, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, you may not access or use our platform and services.

Permission is granted to use FirstReaction for personal and commercial use. This is the grant of a license, not a transfer of title, and under this license you may:

• Create and manage brands, audience segments, and ad campaigns
• Run AI-powered simulations to predict campaign performance
• Access engagement scores, CTR predictions, sentiment analysis, and improvement suggestions
• Upload and manage creative assets for your campaigns

This license shall automatically terminate if you violate any of these restrictions.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Not share your account credentials with others
• Be at least 18 years of age

You agree not to use our services to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload harmful, offensive, or illegal content as campaign creatives
• Attempt to gain unauthorized access to our systems
• Interfere with the normal operation of our services
• Use our services for spam or fraudulent activities
• Reverse engineer or attempt to extract our source code
• Circumvent or abuse simulation quotas or rate limits

Your Content

You retain ownership of any campaign creatives, ad copy, audience segments, and other content you create or upload using our services. By using our services, you grant us a limited license to store, process, and analyze your content to provide our simulation services.

Our Content

All software, features, AI models, and functionality of FirstReaction are owned by Ratnamala Jartarghar and protected by copyright, trademark, and other intellectual property laws.

FirstReaction uses artificial intelligence to simulate audience responses to your ad campaigns. You acknowledge and agree that:

• AI simulation results — including engagement scores, CTR predictions, sentiment analysis, and improvement suggestions — are estimates and predictions, not guarantees of actual campaign performance
• AI-generated outputs may contain inaccuracies or inconsistencies
• You assume full responsibility for decisions made based on simulation results
• Actual campaign performance may differ significantly from simulated results

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

You acknowledge that we may access and disclose your information if required by law or if we believe such action is necessary to protect our rights or comply with legal proceedings.

Some features require a paid subscription:

• Subscription fees are charged in advance
• Fees are non-refundable except as described in our Refund Policy below
• We may change pricing with 30 days notice
• You may cancel your subscription at any time
• Access to premium features ends when your subscription expires

We want you to be satisfied with your experience. Please review our refund policy for subscriptions:

• All Subscriptions: You may request a full refund within 14 days of any payment — whether it is your initial purchase or a renewal. No conditions apply; simply contact us within the 14-day window and your refund will be issued.
• After the 14-day window, no refunds will be issued for the current billing period, but you may cancel at any time to prevent future charges.
• Refund requests must be sent to support@firstreaction.ai with your account details.
• Refunds will be processed to your original payment method within 5–10 business days.

We strive to provide reliable service, but we do not guarantee that our services will be:

• Available at all times without interruption
• Free from errors or defects
• Compatible with all devices or browsers
• Secure from unauthorized access

We reserve the right to modify, suspend, or discontinue our services at any time.

Our services are provided “as is” without warranties of any kind. We disclaim all warranties, express or implied, including:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy or reliability of AI-generated content
• Warranties that our services will meet your requirements
• Warranties that our services will be uninterrupted or error-free

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Costs of procurement of substitute services
• Service interruptions or delays
• Decisions made based on AI simulation results

Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another person or entity.

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including:

• Breach of these Terms of Service
• Violation of applicable laws
• Fraudulent or harmful activity
• Extended periods of inactivity

Upon termination, your right to use our services will cease immediately, and we may delete your account and data.

These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Hubli, Karnataka, India.

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our platform. Your continued use of our services after such changes constitutes acceptance of the new terms.
